Art. 40 [第四十条【売主の知っていた不適合】]
物品の不適合が、売主が知り、又は知らないことはあり得なかった事実であって、売主が買主に対して明らかにしなかったものに関するものである場合には、売主は、前二条の規定に依拠することができない。
